TERMS AND CONDITIONS

These Terms and Conditions apply to Realty Career Advocates, LLC and its websites and products located at realtyconnection.com and ontaskrecruiter.com (the “Website”). For the purpose of these Terms and Conditions, Realty Career Advocates, LLC can be referred to as “we”, “us”, or “our” as required by the context. In addition, “Members” refers to any business advertised on our Website, even if not service related. Members may include real estate companies, mortgage companies, title companies, etc. By visiting the Website and/or using the suite of Realty Career Advocates, LLC services located on the Website (the “Services”), you agree, without limitation or qualification, to be bound by, and to comply with, these Terms and Conditions and any other posted guidelines or rules applicable to the Services. All such guidelines and rules are hereby incorporated by reference into the Terms and Conditions. If you refuse to be bound these Terms and Conditions, or by any future provisions or amendments to these Terms and Conditions, you will have the option to cancel your membership as of the renewal date (see cancellation policy for the correct procedure).

Prohibited Uses

You may use the Services only for lawful purposes and in accordance with these Terms and Conditions. You agree not to:

  1. I. Use the Services in any way that violates any applicable federal, state, local or international law or regulation (including, without limitation, the Telephone Consumer Protection Act (TCPA), the Federal Trade Commission’s National Do Not Call Registry, the CAN-SPAM Act, Canada’s Anti-Spam Legislation (CASL), the Fair Credit Reporting Act (FCRA) and other applicable laws or regulations governing advertising, marketing, data privacy or data protection;
  2. II. Use the Services to transmit, or procure the sending of, any advertising or promotional material without prior written consent, including any “junk mail”, “chain letters” or “spam” or any other similar solicitation;
  3. III. Use the Services to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Website or Services, or which, as determined by Realty Career Advocates, LLC , may harm Realty Career Advocates, LLC or visitors to the Website or users of the Services, or expose us to liability; or
  4. IV. Introduce any viruses, trojan horses, worms, logic bombs or other material which is malicious or technologically harmful, or to otherwise attempt to interfere with the proper working of the Website or the Services.

Profile Maintenance

Realty Career Advocates, LLC shall not be held liable or responsible in any way for Members’ maintaining and updating of their user profile, including but not limited to, contact information, service information, coupons, discounts, etc. Member is responsible for keeping information current. Member also agrees that providing false information or phony coupons is strictly prohibited. Member also agrees and represents that they have the written permission from their company to use, upload, or advertise any logos, images, text copy, and business information within their profile on our Website. Realty Career Advocates, LLC is not responsible at any time for the misuse of trademarks and copyrights on individual profiles or coupons and it is understood that you as the Member will be held liable for such damages including attorney fees should this issue occur. You hereby agree to provide true and accurate information with reference to insurance, bonds, awards, and any and all information within your profile.

Billing and Renewal Policy

  1. Some Services are offered on a monthly agreement. The initial prices for these Services will be established in the checkout page on the Website. Realty Career Advocates, LLC reserves the right to change the pricing for the different Services at any time with 30-days’ notice. You will be bound by this new pricing upon renewal of any monthly or annual services after the 30-day notice period.
  2. It is your, the account holder’s, responsibility to provide Realty Career Advocates, LLC with a valid credit card number and authorize Realty Career Advocates, LLC to charge this account for any Services provided to you. You agree to keep Realty Career Advocates, LLC updated with current credit card information and provide new credit card information in the case that your old card is deactivated or has insufficient funds to cover your membership fees.
  3. Realty Career Advocates, LLC does reserve the right to place your account on hold, deactivate the Services, or terminate the agreement if your account falls into arrears. If you have an outstanding balance at the time of termination or cancellation, this balance must be paid in full.
  4. The Services are billed in advance on a pre-paid basis and will automatically renew for additional periods of equal length on a month to month or annual basis depending on your selection. Billing dates take place on business days and if your month to month or annual anniversary falls on a weekend, our systems will automatically process your payment on the previous business day.
  5. In the event that you wish to dispute any fee Realty Career Advocates, LLC has charged against your account, you agree to discuss the issue with Realty Career Advocates, LLC in order to resolve the issue.

Declined, refused, and/or returned payments may result in a $25.00 service fee to your account for each billing event that is declined, refused or returned. In the event your credit card declines or payment not made within agreed upon period or if you file a dispute without first attempting to correct a billing concern with Realty Career Advocates, LLC member services - documented by an open accounting ticket - your account will be disabled immediately and the leads generated by Realty Career Advocates, LLC system will become the property of Realty Career Advocates, LLC after 30 days if your account is not brought current and paid in full for the period service was rendered.

Ownership

You acknowledge that Realty Career Advocates, LLC owns all right, title, and interest, including all intellectual property rights, in and to the Website, Services, and any and all intellectual property rights in the foregoing. Except for the limited rights and licenses expressly granted under these Terms and Conditions, nothing in these Terms and Conditions grants, by implication, waiver, estoppel, or otherwise, to you or any third party any intellectual property rights or other right, title, or interest in or to the Website, Services and any and all intellectual property rights in the foregoing.

Cancellations

  1. The purpose of these Terms and Conditions is to protect the rights of the Member as well as Realty Career Advocates, LLC . It prevents others from maliciously canceling a Member’s account and also provides the Member and Realty Career Advocates, LLC with written documentation of the Member’s intent to cancel.
  2. Realty Career Advocates, LLC will not honor cancellation requests made via voice-mail. Instead, cancellations must be requested and received either in writing by postal mail sent to Realty Connection, LLC, 1998 Green Oaks Dr., Greenwood Village, CO 80121 or via email sent to info@realtyconnection.com. In some cases, Realty Career Advocates, LLC will verbally contact the Member to ensure that the account cancellation was not requested by someone other than you, the Member.
  3. Members have the right to cancel their account at any time, however, Services are billed in whole billing periods only. If a Member wishes to cancel their account part way through their billing cycle, they will be charged for the entire billing cycle. Members will not, in any way, be prorated for unused time on their agreement.
  4. Cancellation requests must be received no less than 30 days prior to the end of your billing cycle term. In circumstances where you do not cancel your account prior to the renewal date, you are liable for payment of the entire term of 12 months.
  5. Realty Career Advocates, LLC may terminate and/or temporarily suspend a Member’s use of or access to the Services if Realty Career Advocates, LLC reasonably determines that Member’s use of the Services violates these Terms and Conditions and/or any applicable law or regulation.

Disclaimer

REALTY CAREER ADVOCATES, LLC AND THE SERVICES ARE PROVIDED "AS IS" AND REALTY CAREER ADVOCATES, LLC HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. REALTY CAREER ADVOCATES, LLC SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ALL WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE. REALTY CAREER ADVOCATES, LLC MAKES NO WARRANTY OF ANY KIND THAT REALTY CAREER ADVOCATES, LLC , OR ANY SERVICES OR RESULTS OF THE USE THEREOF, WILL MEET YOUR OR ANY OTHER PERSON'S REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, ACHIEVE ANY INTENDED RESULT, BE COMPATIBLE OR WORK WITH ANY SOFTWARE, SYSTEM OR OTHER SERVICES, OR BE SECURE, ACCURATE, COMPLETE, FREE OF HARMFUL CODE, OR ERROR FREE. IN PARTICULAR, YOU UNDERSTAND AND AGREE THAT THE SERVICES ARE NOT WARRANTIED, GUARANTEED, OR REPRESENTED TO BE IN COMPLIANCE WITH THE TCPA OR SIMILAR LAWS OR REGULATIONS.YOU ACKNOWLEDGE AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR COMPLYING WITH ANY AND ALL APPLICABLE STATE, FEDERAL AND INTERNATIONAL LAWS AND REGULATIONS, INCLUDING BUT NOT LIMITED TO, THE TCPA, THE FEDERAL TRADE COMMISSION’S DO NOT CALL REGISTRY, THE CAN-SPAM ACT, CASL, THE FCRA, AND OTHER APPLICABLE LAWS OR REGULATIONS GOVERNING ADVERTISING, MARKETING, DATA PRIVACY OR DATA PROTECTION.

Limitation on Liability

IN NO EVENT WILL REALTY CAREER ADVOCATES, LLC , ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO THE WEBSITE, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE INCLUDING THE EXECUTIVE RECRUITING CALL SERVICES PROVIDED BY A THIRD PARTY PROVIDER OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to defend, indemnify and hold harmless Realty Career Advocates, LLC , its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgements, awards losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to: (i) your violation of any applicable law or regulation, including the TCPA, the Federal Trade Commission’s National Do Not Call Registry, the CAN-SPAM Act, CASL, or the FCRA; and (ii) any violation of these Terms and Conditions or your use of the Services other than as expressly authorized in these Terms and Conditions including the acts or omissions of You or a Third Party Provider related to the Executive Recruiting Call Services, or your use of any information obtained from the Website or the Services.
